COMPLAINT: |
I am sending this communication with regard to the sum of 39,168 USD paid to supplier HK Trading through Bank by me by opening a Letter of Credit. The said amount was paid to you for supplying 32 MTS ie., 32 metric tons of Aluminium scrap Extrusion 6063, 32 mts. Even though the quantity for which the contract entered into was only 32 MT, the Supplier HK trading stated that the quantity sent was 32.640 Mts on weighing and collected 39,168 USD. The purchase order was placed before HK trading on the basis of his promise. HK Trading promised to send:- 1) 32.640MTS of Aluminium scrap of the specifications mentioned in the contract. 2) HK Trading promised to send Pre-shipment Inspection Certificate from an approved agency, recognised by the Indian Customs. supplier have sent the materials through Ship Hyundai Smart 015W16. It reached the Tuticorin Port, India in 2 consignments, stating that each container contained a little over 16 tons. Believing his representations, I parted with 39,168 USD through Bank. I also received the Pre-shipment Inspection Certificate sent by him on the letter head of one M/s.Alfred H. Knight. The said letter head mentions that it was an agency, recognised the by Indian Customs. supplier also stated that the said agency Alfred H.Knight was recognised by the Indian Customs and the said agency verified the quantity and the specifications of the goods sent by him. When I enquired the Customs Department, I was shocked to be told that the said M/s.Alfred H. Knight is not recognised by the Indian Customs. I contacted M/s.Alfred H.Knight who stated that they have not issued the certificate in question. It is clear that HK trading have fabricated a false certificate.
